Terms of Service

1. Acceptance of Terms

By accessing or using the PlantBreed platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Service Description

PlantBreed provides AI-generated breeding intelligence reports including trait dossiers and patent intelligence briefs. Reports are generated from curated scientific literature, patent databases, and genebank records. Reports are provided for informational purposes and do not constitute legal, agronomic, or breeding advice.

3. User Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your credentials. You must be at least 18 years old or have organizational authorization to use the Service.

4. Acceptable Use

You agree not to: (a) reverse-engineer the Service; (b) use automated tools to scrape reports; (c) redistribute generated reports commercially without attribution; (d) attempt to circumvent access controls or rate limits.

5. Intellectual Property

The platform, its design, and underlying models are the property of PlantBreed. Generated report content may be used freely within your organization for breeding decisions. Patent landscape data is sourced from public filings and does not constitute legal opinion.

6. Limitation of Liability

The Service is provided "as is" without warranties of any kind. PlantBreed shall not be liable for decisions made based on generated reports, including but not limited to breeding program investments, patent filing decisions, or germplasm acquisitions.

7. Termination

We may suspend or terminate your account for violation of these Terms. You may delete your account at any time by contacting support.

Europe-Specific Terms

For users accessing the Service within the European Economic Area (EEA), the following additional terms apply:

GDPR Compliance

PlantBreed processes personal data in accordance with the EU General Data Protection Regulation (GDPR). Your data controller is PlantBreed Ltd. See our Privacy Policy for details on data processing, retention, and your rights.

EU Plant Variety Rights

Patent intelligence reports referencing EU plant variety rights (CPVR) are based on CPVO public register data. The breeder's exemption under Article 15 of Council Regulation (EC) No 2100/94 is noted where applicable.

NGT Regulation

Reports may reference the EU New Genomic Techniques (NGT) regulation framework. Category 1 and Category 2 NGT classifications are indicated where gene editing data is available for the selected trait.

Africa-Specific Terms

For users accessing the Service for African breeding contexts, the following additional terms apply:

CGIAR & Public Sector Data

Reports for African crops incorporate data from CGIAR centers (CIMMYT, IITA, ICRISAT, ICARDA, AfricaRice) under open-access data policies. Germplasm accession data follows the International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA) Standard Material Transfer Agreement (SMTA) framework.

Humanitarian Use

Patent intelligence briefs for Africa include notes on humanitarian-use licenses and royalty-free access agreements applicable to smallholder farming contexts in sub-Saharan Africa.

National Regulations

Regulatory information (seed certification, variety release, biosafety) is indicative and based on publicly available national frameworks. Users should verify current requirements with their national plant variety protection office or biosafety authority.
